About the Defence Force Remuneration Tribunal

The Defence Force Remuneration Tribunal is an independent statutory authority established under section 58G of the Defence Act 1903 (Cth). The Tribunal's role is to:

• Inquire into and determine the salaries and relevant allowances to be paid to members of the Australian Defence Force; and

• Inquire into and make determinations on prescribed matters that have been referred to the Tribunal.

The Tribunal's work is predominantly determined by the matters brought before it by the parties, in particular the Australian Defence Force. To deal with these matters, the Tribunal conducts hearings as and when required.

The Tribunal is supported by a secretariat staffed by the Australian Public Service Commission.

The Tribunal consists of three part-time Members, being:

• A President, who is also a current Deputy President of the Fair Work Commission;

• A Member who is experienced in industrial relations matters; and

• A Member who was, but is no longer, a member of the Permanent Forces (although the person may be a member of the Reserves).

About the Role

The Australian Government is seeking expressions of interest from suitably qualified people for appointment to the position of Member experienced in industrial relations of the Defence Force Remuneration Tribunal.

Members are appointed by the Governor-General (on advice from the Hon Patrick Gorman MP, Assistant Minister for the Public Service) on a part-time basis for a term of up to 5 years.

Members are appointed to hear and determine salary and relevant allowances for members of the Australian Defence Force.

The Member experienced in industrial relations applies their extensive knowledge of, and experience with, contemporary industrial relations and economic matters to inform the business of the Tribunal, including by liaising with other Tribunal Members and the parties before the Tribunal in scrutinising complex remuneration proposals.

On appointment, the Member experienced in industrial relations will be expected to:

• Be available for Tribunal hearings and briefings in the ACT and other locations, as required by the President of the Tribunal - approximately 2-3 days per month;

• Attend physical inspections hosted by the Australian Defence Force, including overnight travel where required;

• Deal with all matters impartially according to law; and

• Liaise with other Tribunal Members and the Australian Public Service Commission on ancillary matters relevant to the administration of the Tribunal.

Desirable Skills, Experience and Qualifications

Expressions of interest are sought from people with extensive professional industrial relations experience. As an accomplished senior executive in the public or private sector, they will have strong knowledge and relevant experience of industrial relations, demonstrated in one or more of the following contexts:

• Employment law;

• Industrial tribunals;

• Senior human resources or workplace relations management;

• Business, industry or commerce;

• Government; or

• Community.

Eligibility

• Under section 58G(2)(b) of the Defence Act 1903 (Cth), the Tribunal shall consist of a person who is experienced in industrial relations matters.

• Under section 58G(5) of the Defence Act 1903 (Cth) a person must not be appointed as a Member of the Tribunal if he or she has, at any time during the year preceding the appointment, been a member of the Permanent Forces.

• Successful applicants may be required to undergo security checks.

Remuneration

Remuneration is set by the Remuneration Tribunal in Remuneration Tribunal (Remuneration and Allowances for Holders of Part-time Public Office) Determination (No. 2) 2023.

• An Expression of Interest (no more than one page or 750 words), outlining your skills, experience, qualifications and motivation to undertake the role of the Member experienced in industrial relations of the Tribunal;

• A current curriculum vitae (maximum of three pages) detailing:

o Employment experience;

o Academic Qualifications;

o Membership of professional/community bodies; and

o Any current or previous experience on Boards or Tribunals.

Shortlisting

The interview panel will shortlist candidates based on their expression of interest and curriculum vitae.

Interview Process

Interviews may be conducted either in person or via video conference.

Reference checks

Reference checks may occur during or shortly after the interview stage.

Appointment Process

The selection panel will provide a list of suitable candidates to the Assistant Minister for the Public Service for consideration. The Assistant Minister for the Public Service will consider the outcomes of the assessment process and recommend a candidate for appointment.

The Australian Government will consider the proposed appointment in line with the requirements set out in the Cabinet Handbook before a final recommendation is made to the Governor-General.
